CULTURE NIGHT DATA PROTECTION NOTICE

The Arts Council of Ireland is the Irish government agency for developing the arts. We work in partnership with artists, arts organisations, public policy makers and others to build a central place for the arts in Irish life.
Culture Night is the annual all-island event that celebrates culture, creativity and the arts under the stewardship of the Arts Council and run in partnership with local authorities, institutions and individuals across the country in the arts and culture sector.
This Culture Night Privacy Notice (“Notice”) sets out specific information relating to how we, the Arts Council process data when you engage with us to organise Culture Night Activities, participate in Culture Night Events, visit the Culture Night website or engage with our social media.
This is a supplementary Notice intended to be read in conjunction with our general Privacy Notice which is available on our website at https://artscouncil.ie/privacy-notice/.
The Arts Council is the data controller regarding the data described in this notice. We are subject to Irish and EU laws, including the General Data Protection Regulation (EU Regulation 679/2016), Irish Data Protection Acts 1988 to 2018, the ePrivacy Regulations 2011 and Privacy and Electronic Communications Directive 2002/58/EC on Privacy and Electronic Communications.
We treat the protection of your personal data seriously and when we collect and process your Personal Data, we will do so in accordance with the GDPR and relevant local data protection laws (the “Data Protection Laws”).

Who This Data Protection Notice Applies to
This Data Protection Notice applies to the following:
- If you are a member of the public visiting our website or enjoying Culture Night events;
- If you are a County Council or Arts Organisation who is involved in running a culture night activity or co-ordinating activities in your local area; or
- If you are an artist or member of a community group participating in a Culture Night activity.
THE ARTS COUNCIL ROLE
The Arts Council is primarily responsible for funding support and coordination of Culture Night. We manage and promote the Culture Night through the website, social media and media campaigns.
INFORMATION FOR CULTURE NIGHT ATTENDEES AND WEBSITE VISITORS
Culture Night Events are organised and run by your local Arts Organisations supported by your City and County Councils. The Arts Council supports coordination of Culture Night events information by hosting a Culture Night website, sending out newsletters and promoting Culture Night across social media platforms.
We will process individuals Personal Data when you visit the Culture Night website, engage with content on social media or sign-up to receive our newsletter.
If you complete a survey about your Culture Night experience, aggregated and de-identified survey results may be shared with us by the Council or Arts Organisation who conducts the survey.
INFORMATION FOR COUNTY COUNCILS AND ARTS ORGANISATIONS
The Culture Night website facilitates Arts Officers and employees from County Councils to provide information about Culture Night events in your area.
We will process your personal data where you are a registered user coordinating or organising Culture Night events, and when we communicate with you about event promotion.
INFORMATION FOR ARTISTS AND CULTURE NIGHT PARTICIPANTS
The Culture Night website promotes events involving artists and community participants organised across the country. All other activities related to organising and funding of events is managed by your local County Council.
The Culture Night website publishes information supplied about the artist and community participants involved in events which may include professional information and images provided by you.
CATEGORIES OF APPLICANTS PERSONAL DATA
The table below sets out the general categories of Personal Data that we collect.

RETENTION OF PERSONAL DATA
We only keep your Personal Data as long as it is necessary for the purposes of processing it.
Our retention policy is as follows:

In some circumstances it is not possible for us to specify in advance the period for which we will retain your Personal Data. In such cases we will determine the appropriate retention period based on balancing your rights against our interests. We may also retain certain Personal Data beyond the periods specified herein in some circumstances such as where required for the purposes of legal claims. We may also delete Personal Data earlier than the specified Retention Period where the Personal Data is no longer required for the purpose.
DISCLOSURE OF PERSONAL DATA
The Arts Council, in the course of our business and where necessary and proportionate, may share your information with third parties. We carry out appropriate due diligence checks on third parties we engage with, and we have contracts and agreements in place with third parties, including assessors, consultants and suppliers.
NTERNATIONAL DATA TRANSFERS
The Arts Council use some third parties that are based outside of the European Economic Area (EEA). This means that your data may be transferred to a country outside of the EEA. Where such transfers occur, we ensure a similar level of protection or safeguard is provided to your data. The Arts Council may also transfer your data to countries that have been deemed by the European Council to provide an adequate level of protection of data.

AMENDMENTS TO THIS DATA PROTECTION NOTICE
We will post any changes to this Data Protection Notice on the Culture Night website and when doing so will change the effective date at the top of this Data Protection Statement.
In some cases, we may provide you with additional notice of changes to this Data Protection Statement, such as via email. We will always provide you with any notice in advance of the changes taking effect where we consider the changes to be material.
